These conditions govern the rights and obligations of Karima Duchamp registered under the French number of Siret 452 405 731 00012 and of its client in the context of the online sale of works of art created and produced by Karima Duchamp. Any service performed by Karima Duchamp therefore implies the buyer's full acceptance of these general conditions of sale.

Article 2 - Order

Orders are placed through the e-shop online store. Any payment by the customer constitutes a firm and final order.

Article 3 - Validation of your order

Any order appearing on the website www.karimaduchamp.net implies acceptance of these General Conditions. Any order confirmation entails your full acceptance of these general conditions of sale, without exception or reservation.

All the data provided and the confirmation recorded will constitute proof of the transaction.

You declare that you are fully aware of it.

The order confirmation will be worth signature and acceptance of the operations carried out.

A summary of your order information will be sent to you by email confirming your order at the address you have given.

Article 4 - Price

The prices of our products are indicated in euros, net of VAT (VAT not applicable, art. 293B of the CGI), unless otherwise indicated and excluding processing and shipping costs. Consequently, they will be increased by the VAT rate (if this applies) and the packaging and transport costs applicable on the day of the order. Karima Duchamp grants itself the right to modify its prices at any time, but the product will be invoiced on the basis of the price in force at the time of the validation of the order and subject to availability. Our prices are subject to change without notice, depending on economic conditions (price revision conditions and calculation formula).

Karima Duchamp reserves the right not to record a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.

When ordering to a country other than France, you are the importer of the product (s) concerned. Customs duties or other local taxes or import duties or state taxes may be due. These rights and sums are not the responsibility of Karima Duchamp. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities in your country. We advise you to find out about these aspects from your local authorities.

All orders regardless of their origin are payable in euros.

Shipping costs will be borne by the purchaser and payable by bank card or PayPal account.

Shipping in France and worldwide is possible, shipping costs include preparation and packaging costs as well as shipping costs and will be detailed on the invoice.

In the event of a dispatch, the products are delivered to the delivery address indicated during the ordering process, within the period indicated on the order validation page.

All packages are sent as follow-up from deposit to delivery.

The time of shipping indicated are indicative times, corresponding to the average times for processing and delivering packages. Karima Duchamp cannot be held responsible for any delay beyond the indicative deadlines. Karima Duchamp cannot be held responsible for late delivery due exclusively to the unavailability of the customer at the time of delivery of the products.

In the event of delay in dispatch, an email will be sent to you to inform you of a possible consequence on the delivery time which has been indicated to you. A delay in shipment cannot be considered as a reason for canceling the order, nor give rise to the payment of damages or penalties for delay.

Each order is packed with the most care and perfectly protected for shipment in suitable packaging. In the event of loss or breakage by the carrier, Karima Duchamp cannot be held responsible.

If despite the care taken with the packaging, the ordered work(s) arrive damaged, please contact me as soon as possible.

In case of damaged package, the Customer agrees to notify the carrier and Karima Duchamp within 3 days of delivery of the package (not including bank holidays) by a letter with acknowledgment of receipt (article L133 -3 of the French commercial code).

Article 6 – Payment

Confirming your order means that you have to pay the indicated price.

Payment for your purchases is made through the secure payment services provided by the Full PayPal Service: payment by national or international bank cards or by PayPal account.

To confirm the order, the buyer must pay the total amount of the order.

Article 7 - Withdrawal and reimbursement

In accordance with the provisions of article French L.121-21 of the Consumer Code, you have a withdrawal period of 7 days from the receipt of your products to exercise your right of withdrawal without having to justify reasons or to pay penalty.

Returns must be made in their original condition and complete (packaging, accessories, instructions). In this context, your responsibility is engaged. Any damage suffered by the product on this occasion may be such as to defeat the right of withdrawal.

Return costs are your responsibility. The products must be returned in their original packaging to Karima Duchamp 40 rue des trois rois 68100 Mulhouse France.

In the event of the exercise of the right of withdrawal, Karima Duchamp will reimburse the amounts paid, within a maximum period of 30 days after receipt by it of the products. The reimbursement will be made according to the same method of payment chosen by the customer when ordering.

Article 8 - Retention of title

Karima Duchamp retains ownership of the goods sold until full payment of the price. As such, if the customer is the subject of a legal redress or a judicial liquidation, Karima Duchamp reserves the right to claim, within the framework of the collective procedure, the goods sold and remained unpaid. The ownership of the delivered goods is reserved to us until full payment of the price and its accessories. By express agreement, Karima Duchamp reserves the ownership of the goods until the last day of their perfect payment.

Article 9 - Intellectual property

Article 10 - Force Majeure

The responsibility of Karima Duchamp cannot be implemented if the non-execution or the delay in the execution of one of the obligations written in these general conditions of sale results from a case of force majeure. As such, force majeure means any external, unforeseeable and irresistible event within the meaning of article 1148 of French Civil Code.

Article 11 - Applicable law in the event of disputes

Any order automatically implies the client's acceptance of the general conditions of sale. These conditions of sale are subject to French law. In the event of a dispute, the French courts will have sole jurisdiction.

Article 12 - Personal data

The company Karima Duchamp reserves the right to collect nominative information and personal data concerning you. They are necessary for the management of your order, as well as for the improvement of the services and information that we send to you.

They also allow us to send you customer loyalty and promotion operations by email which are not opposed, on products similar to those ordered and on other products offered by Karima Duchamp.

The categories of data kept by Karima Duchamp are as follows:

• Identity: title, surname, first name, address, delivery address, telephone number, email address,

• Data relating to orders: transaction number, details of purchases, amount of purchases, data relating to payment of invoices (payments, unpaid, discounts), return of products.

• Data necessary for carrying out loyalty and prospecting actions: purchase history.
